Questions and Answers - Interpretation Decision on Additional Pain and Suffering Compensation

Does the Interpretation Decision change a previous assessment decision I received about my Additional Pain and Suffering Compensation (APSC)?

The Interpretation Decision does not change or overturn any previous APSC decisions. If you are not satisfied with your APSC decision, you can come to the Veterans Review and Appeal Board for a review of that decision. There is no time limit on when you can do this.

Free legal representation is available from the Bureau of Pensions Advocates (1-877-228-2250) and Royal Canadian Legion (1-877-534-4666). You may also choose to represent yourself or use private representation at your own cost, by notifying the Board in writing.

How does the Veterans Review and Appeal Board make decisions for Additional Pain and Suffering Compensation assessments?

The Board applies the Pension Act and the Veterans Well-being Act to all disability benefits cases. Board Members evaluate evidence, listen to testimonies, and apply legal standards to determine if a Veteran’s disability is related to their military service. The Board relies on the legislation and Veterans Affairs Canada’s policies to make decisions.
